Public Notice for Sector 12/C

This is to inform the general public. Please note that this public notice/warning is regarding the property including the construction built on plot no. 386/A/2, 90-00 sq.m., located in Sector No. 12/C, Township area in District Gandhinagar, owned by Anjana Co. O.H.S. Ltd. The above-mentioned property was allotted by the government to the father of our clients, Dalsukh Bhai Mulabhai Baraiya, who was a government employee. After the allotment of the plot, he built the property on the plot as per rules and has been enjoying the property as owner, buyer, and beneficiary. Our client's father Dalsukh Bhai Mulabhai Baraiya passed away on 09/06/2007. After that, our clients, Minaben Dalsukh Bhai Baraiya and Vimlaben Dalsukh Bhai Baraiya, the daughters of our client, have been enjoying the property by inheritance. As there is a dispute regarding the inheritance rights of other heirs of Dalsukh Bhai Mulabhai Baraiya in this property, our client has filed a lawsuit seeking partition and permanent injunction in the Principal Senior Court, Gandhinagar, in R.D.M. No. 28/2025. The case is currently subjudice. However, despite the knowledge and consent of our client, the locks of the said property were broken, the household goods and assets of our client were stolen, and the property was rented out by some individuals falsely claiming it as their own independent property. We came to know about this and our client filed a complaint with the Sector 7 Police Station. Some brokers are spreading false rumors that they have purchased the said property by showing fake documents or papers, power of attorney, etc., and are trying to harm the rights and interests of our client. The said property is being jointly owned by the heirs of Dalsukh Bhai Mulabhai Baraiya by inheritance. Our client has not given any documents, agreements, power of attorney, or any other documents related to their share in the said property to any person or broker. The general public is hereby requested to take note of this. However, if any person or broker comes forward with fake deeds, agreements, powers, or any other documents regarding this property, the general public should be vigilant about this. No person shall sell, rent, or otherwise deal with the said property without the presence and consent of our client. Any attempt to purchase, rent, mortgage, or agree upon this property through any fraudulent documents will be the sole responsibility of the person making such documents or agreements. Our client will not be responsible for this. Our client has initiated legal action against such fraudulent elements. The general public is requested to take note of this public warning. આથી જાહેર જનતાને આ જાહેર! નોટીસ/જાહેર ચેતવણીથી જાણ કરવામાં આવે છે કે ડીસ્ટ્રીક્ટ સબ ડીસ્ટ્રીક્ટ ગાંધીનગરતા ટાઉનશીપ વિસ્તારમાં આવેલ સેક્ટર નં.૧૨/સી, જેઅંજનાકો.ઓ.હા.સો.લી.ના પ્લોટ નં. ૩૮૬/એ/૨,ના ૯૦-૦૦, ચો.મી.ના પ્લોટ ઉપર બાંધવામાં આવેલ બાંધકામ સહીતની મિલ્કત અંગે જાહેર ચેતવણી. ઉપરોક્ત જણાવેલ મિલ્કત અમારા અસીલોના પિતાશ્રી] દલસુખભાઈ મુળાભાઈ બારૈયા સરકારી કર્મચારી તરીકે સરકારશ્રીએ પ્લોટ ફાળવ્યા બાદ સદર પ્લોટ ઉપર, નિયમ મુજબ બાંધકામ કરી માલિક, ક્જેદાર, અને ભોગવટેદાર તરીકે ભોગવટો કરતા આવેલા. અમારા અસીલના પિતાજી દલસુખભાઈ મુળાભાઈ બારેયાનું તા.૦૯/૦૬/ ૨૦૦૭,ના રોજ અવસાન થયેલ. ત્યાર બાદ સદર મકાનમાં અમારા અસીલશ્રી મિનાબેન દલસુખભાઈ બારૈયા તથા વિમલાબેન દલસુખભાઈ બારૈયાની દિકરીઓ વારસાઈ હકકે કબ્જો ભોગવટો કરતા આવેલા છે. તેમજ સદર મિલ્કતમાં દલસુખભાઈ મુળાભાઈ બારરૈયાના અન્ય વારસના| હક્ક હિસ્સાની વારસાઈ તકરાર ચાલતી હોય તે બાબતે અમારા અસીલે પ્રિન્સિપાલ સિનિયર કોર્ટ ગાંધીનગર, ખાતે રૈ.દી.મુ.નં.૨૮/૨૦૨૫,થી| પાર્ટીશન તેમજ કાયમી મનાઈ હુકમ માંગતો દાવો દાખલ કરેલ છે. જે હાલ સબજયુડીસ છે. તેમ છતા અમારા અસીલની સહી સંમતિ અને જાણ બહાર સદર મિલ્કતના તાળા તોડી અમારા અસીલની ઘરવખરી સરસાધનો રફે દફે કરી ગેરકાયદેસર, રીતે સ્વતંત્ર માલિકીની હોવાનું, જૃખ્નાવી ભાડે આપેલ હોવાનું અમારા! અસીલની જાણમાં આવતા અમારા અસીલે આ બાબતે સેકટર ૭, પોલીસ સ્ટેશનમાં ફરિયાદ કરેલ છે. તેમજ અમુક લે ભાગુ દલાલો આ મિલ્કતના બનાવટી લખાણો કે કાગળો પાવર ઓફ એટર્ની બતાવી સદર મિલ્ક્ત ખરીદ કરેલ હોવાની ખોટી અફવાઓ ફેલાવી અમારા અસીલના હક્ક હિતને નુકશાન થાથ તેવા પ્રયતો કરી રહેલ છે.સદર મિલ્કત દલસુખભાઈ મુળાભાઈબારૈયાના વારસોની સંયુક્ત સહમાલીક તરીકે વારસાઈ હક્કની ચાલતી આવેલ છે.અમારા અસીલે સદર મિલ્કતમાં તેમના હિસ્સાના લખાણો, કરારો કે પાવર ઓફ એટની કે અન્ય કોઇ લખાણો કોઇપણ ઈસમ કે દલાલોને કરી આપેલ નથી. જેની! જાહેર જનતાએ નોંધ લેવી, તેમ છતાં, આવા કોઇ ઈસમો કે દલાલો આ મિલ્કત અંગે બનાવટી ફોડ લખાણો, કરારો, પાવર કે અત્ય કોઇપણ જાતના લખાણો ઉભા કરી લઈને આવે તો આ બાબતે જાહેર જનતાએ જાગૃત રહેવુ. અમારા અસીલની રૂબરૂ ઉપસ્થિતિ! અને સહી સંમતિ સિવાય કોઇપણ ઈસમે સદર મિલ્કતનાં વેચાણ, ભાઠા! કરાર કે બાનાચીટ્ટી કરી અમારા અસીલના હક્ક હિતને નુકશાન થાય તેવા કોઇ પણ પ્રકારના ફોડ લખાણો દ્વારા આ મિલ્કત સબંધી ભાડા પટે કે વેચાણ ગીરો કે કરારો કરી ખરીદ કરવાની કોશીસ કરશે કરાવશે તો તે આ પ્રકારના લખાણો કે કરારો! કરનારની અંગત જવાબદારી રહેશે. જે અંગે અમારા અસીલોની કોઇ જવાબદારી રહેશે નહીં.અમારા અસીલે આવા લે-ભાગુ તત્વો સામે! કાનુની કાર્યવાહી શરૂ કરેલ છે.જેની જાહેર જનતાએ આ જાહેર ચેતવણીથી| નોંધલેવી. ગાંધીનગર તા.૦૧-૦૪-૨૦૨૫ મીનાબેન તે દલસુખભાઈ મુળાભાઈ બારૈયા અમારી મારફતે મહેદ્ર બી. સોલંકી, એડવોકેટ પ્લોટનં.૯૫૪/૧, સે.૩/ી, ગાંધીનગર. ૯૮૨૪૫ ૪૫૨૧૮
