Public Notice for Narmada Yojana Dharangdhra Branch Canal Lakhtar Distri (D-1) Chain 2981 m. to 3067 m. Construction

This is to notify that the Government of Gujarat requires the land mentioned in the attached schedule for public purpose, that is for the construction of Narmada Yojana Dharangdhra Branch Canal Lakhtar Distri (D-1) Chain 2981 m. to 3067 m. 1) Therefore, under section-22 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) (hereinafter referred to as "said Act"), the Government of Gujarat hereby declares its intention to acquire the said land for the public purpose of the above-mentioned infrastructure project legally. 2) Now, when the proposed project Narmada Yojana Dharangdhra Branch Canal Lakhtar Distri (D-1) Chain 2981 m. to 3067 m. Canal construction has been submitted for land acquisition in the said scheduled land, then the total area of the minimum land to be acquired for this project is 00-09-49 sq. m. as per the schedule and it is located within the jurisdiction of Bajrangpura village of Lakhtar taluka of Surendranagar district. 3) Now, when it is necessary in public interest for the State Government to exempt the said area of 00-09-49 sq. m. of land from the implementation of the provisions of Chapter-2 and 3 of the "said Act" for the above-mentioned infrastructure project. 4) Therefore, under section-10 (a) of the "said Act" (Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013) (Gujarat Amendment Act, 2016) (Inserted by section-3 of the Gujarat Act No. 12 of 2019), the State Government hereby exempts the area of 00-09-49 sq. m. of land included in the schedule below for the acquisition of the Narmada Yojana Dharangdhra Branch Canal Lakhtar Distri (D-1) Chain 2981 m. to 3067 m. branch canal infrastructure project in public interest from the implementation of provisions of Chapter-2 and 3 of the "said Act". -:Schedule:-

ગુજરાત સરકાર નર્મદા, જળસંપતિ, પાણી પુરવઠા અને કલ્પસર વિભાગ સચિવાલય, ગાંધીનગર ડરના જમીન સંપાદન પુનઃસ્થાપન અને પુનર્વસવાટમાં વાજબી વળતર અને પારદર્શિતાનો અધિકાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦મો) જીલ્લો : સુરેન્દ્રનગર તારીખ : ૦૫/૦૩/૨૦૨૪ ક્રમાંક : અમ/નજ/૨૦૨૪-૭૯/જસં/૨૦૧ ૮/સુરેનદ્રનગર/૨૫૮/૧૧૮/મ આ સાથેની અનુસુચિમાં દર્શાવવામાં આવેલ જમીનોની જાહેર હેતુ માટે એટલે કે નર્મદા યોજનાની ધ્રાંગધ્રા શાખા નહેરની લખતર ડીસ્ટ્રી (ડી-૧) સાંકળ ૨૯૮૧ મી. થી ૩૦૬૭ મી. ના બાંધકામ માટે જરૂર પડવાનો સંભવ છે એવું ગુજરાત સરકારને જણાય છે. ૧) તેથી જમીનસંપાદન પુનઃસ્થાપન અને પુનર્વસવાટમાં વાજબી વળતર પારદર્શિતાનો અધિકાર અધિનિયમ-૨૦૧૩ (૨૦૧૩નો ૩૦ મો) (જેનો આમાં હવે પછી “ “સદરહુ અધિનિયમ”' તેમ ઉલ્લેખ કરવામાં આવેલ છે તે) ની કલમ-ર૨ (૧) અન્વયે ગુજરાત સરકાર આથી ઉક્ત જમીનો ઉપરોક્ત આંતરમાળખાકીય પ્રોજેક્ટના જાહેર હેતુ માટે કાયદાનુસાર સંપાદન કરવાનો ઈરાદો જાહેર કરે છે. ર૨) હવે જ્યારે ઉક્ત અનુસૂચિત જમીનમાં સૂચિત પ્રોજેક્ટ નર્મદા યોજનાની શ્રાંગ્રા શાખા નહેરની લખતર ડીસ્ટ્રી (ડી-૧) સાંકળ ૨૯૮૧ મી. થી ૩૦૬૭ મી. નહેરના બાંધકામ માટે જમીન સંપાદન માટેની દરખાસ્ત રજુ થયેલ છે, ત્યારે આ પ્રોજેક્ટ માટે સંપાદન કરવાની થતી ઉપરોક્ત ઓછામાં ઓછી જમીનનો અનુસૂચિ મુજબનો કુલ ક્ષેત્રફળ વિસ્તાર હે. ૦૦-૦૯-૪૯ ચો.મી. છે અને તે સુરેન્દ્રનગર જીલ્લાના લખતર તાલુકાના ગામ બજરંગપુરાની હદમાં આવેલ છે. ૩) હવે જ્યારે, ઉપરોક્ત આંતરમાળખાકીય પ્રોજેક્ટ માટે સદરહુ સંપાદન કરવાની થતીક્ષેત્રફળ વિસ્તાર હે. ૦૦-૦૯-૪૯ચો.મી. જમીનને ““સદરહુ અધિનિયમ” ના પ્રકરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપવાનું રાજ્ય સરકારને જાહેર હિતમાં આવશ્યક જણાય છે. ૪) તેથી “સદરહુ અધિનિયમ” ની કલમ-૧૦ (એ) (જમીન સંપાદન પુનઃસ્થાપન અતે પુનર્વસવાટમાં વાજબી વળતર પારદર્શિતાનો અધિકાર અધિનિયમ-૨૦૧૩) (ગુજરાત સુધારા અધિનિયમ-૨૦૧૬) (૨૦૧૯નો ગુજરાત અધિનિયમ નં.૧૨ ની કલમ-૩ થી દાખલ કરેલ) થી મળેલ અધિકારો અન્વયે રાજ્ય સરકાર આથી જાહેર હિતમાં નર્મદા યોજનાની શ્રાંગદ્રા શાખા નહેરની લખતર ડીસ્ટ્રી (ડી-૧) સાંકળ ૨૯૮૧ મી. થી ૩૦૬૭ મી. શાખા નહેરના આંતરમાળખાકીય પ્રોજેક્ટ માટે સંપાદન કરવાની થતી નીચે જણાવેલ અનુસૂચિમાં સમાવિષ્ટ થયેલ ક્ષેત્રફળ વિસ્તાર હે. ૦૦-૦૯-૪૯ ચો.મી. જમીનને ““સદરહુ અધિનિયમ” ના પ્રકરણ-૨ અને ૩ની જોગવાઈઓની અમલવારીમાંથી મુક્તિ આપે છે. -:અનુસૂચિઃ- કેસ નંબર: ૨૮/૨૦૧૮ તારીખ:૦૫/૦૩/૨૦૨૪ જીલ્લોઃ સુરેન્દ્રનગર તાલુકોઃ લખતર મોજે: બજરંગપુરા બ્લોક નંબર/ o જે જાહેર હેતુ માટે જમીન ની જરૂર છે તે સર્વે નંબર જાહેર હેતુ (હે.આરે.ચો.મી.) ર૫૪ 00-0૯-૪૯ સરદાર સરોવર નર્મદા નિગમ લી. હસ્તકની નર્મદા યોજનાની ધ્રાંગધ્રા શાખા નહેરની ફુલ ૦૦-૦૯-૪૯ લખતર ડીસ્ટ્રી (ડી-૧) સાંકળ ૨૯૮૧ મી.થી ૩૦૬૭ મી, ના બાંધકામ માટે ગુજરાતના રાજ્યપાલશ્રી ના હુકમથી અને તેમના નામે, (જે.આઈ.પટેલ) ઉપસચિવ (જ.સં.) નર્મદા, જળસંપતિ, પાણીપુરવઠા અને કલ્પસરવિભાગ, ગાંધીનગર ક્રમાંક/માહિતી/સુરેનદ્રનગર/૦૦૮/૨૦૨૪-૨૫
