Public Notice This is to inform the public that our client Jagdev Ramprasad Sharma, aged 67, a businessman, residing at 8, Nirmal Bungalows, near Siromani Bungalows, opposite Baroda Express Highway, Ahmedabad, hereby issues this legal notice to the public with the advice, instructions and consent of our client. Our client has purchased a non-agricultural plot of land measuring 471.92 sq. meters, along with the common road, common plot and the portion of the land coming under the curve, measuring approximately 36.53 sq. meters, making the total constructed area 486 sq. meters, from the original owner Kamalaben Mangilal Kumavat, situated at Survey No. 31/1, 31/2, TP Scheme No. 1, Nafa Plot No. 236, 237, located in the limits of Odhv village, Vatva Taluka, Ahmedabad district. This transaction was registered on 19.12.2022 in the Odhv sub-registrar office with registration number 14772/2022. Subsequently, the major portion of the consideration amount has been paid. However, Kamalaben Mangilal Kumavat has failed to comply with the terms of the registered agreement as per the registered agreement, and therefore our client has filed a Specific Performance suit against Kamalaben Mangilal Kumavat under section 16 of the Specific Relief Act - 1934, in the Hon'ble City Civil Court, Ahmedabad, on 10.01.2025, bearing Special Civil Suit No. 43/2025. Kamalaben Mangilal Kumavat has appeared before the court and the case is currently pending before the Hon'ble Court. Furthermore, our client has filed a criminal complaint against Kamalaben Mangilal Kumavat at the Odhv Police Station under IPC sections 34, 120b, 406, 409, 420, 467, 468, 191, 2202, 506(1), 506(2) and 114. Therefore, this legal notice hereby warns the public that our client has the priority right to purchase this land. Any individual or institution making any transaction related to this land, including purchase, sale, mortgage, gift or any other type of transaction, will be considered illegal, null and void and will be considered a criminal act. The individual responsible for such transactions will be held personally liable and such transactions will not bind our client. The public is hereby informed of this warning. જાહેર ચેતવણી આથી અમો એન. આર. માધુ, એડવોકેટ, તે અમારા અસીલ જગદેવ રામપ્રસાદ શર્મા, ઉ.વ.આ.૬₹૧, ધંધો.વેપાર, રહે. ૮,નિર્મલ બંગ્લોઝ,સીરોમણી બંગ્લોઝની પાસે, બરોડા એક્સપ્રેસ હાઇવે સામે, અમદાવાદની સ્પણટસલાહ, સૂચના અને સમંતિથી જાહેર જનતા જોગ કાનૂની ચેતવણી આપવાની કે, અમારા અસીલે મોજે ગામ ઓઢવ, તા.વટવા, જી. અમદાવાદની સીમના સર્વે નં. ૩૧/૧, ૩૧/૨ ટી.પી.સ્કીમ નં. ૧ નાફા.પ્લોટ નં.૨૩૬, ૨૩૭ જેનું કુલ ક્ષેત્રફળ ૪૭૧.૯૨ ચો.મીટરની બિનખેતી લાયક જમીન તેમજ જમીનના કોમન રોડ-રસ્તા તથા કોમન પ્લોટતથાકર્વેચર ની જમીનના વરાળે આવતા હિસ્સાની આશરે ૩૬.૫૩ ચો.મી. જમીના થતા બાંધકામ ની જમીન આશરે ૪૮૬ ચો. મી. તેના મૂળ માલિક કમલાબેન માંગીલાલ કુમાવત પાસે થી વેચાણ રાખેલ અતે તે બાબતે તા. ૧૯.૧૨.૨૦૨૨ ના રોજ ઓઢવ સબ રજીસ્ટ્રાર કચેરીએ નોંધાયેલ અનુક્રમ નં. ૧૪૭૭૨/૨૦૨૨ વાળા રજીસ્ટર બાનાખત થયેલ છે. ત્યાર બાદ મોટા ભાગનું અવેજ ચૂકવી ગયેલ છે. જે પરત્વે મોટા ભાગનું અવેજ ચુક્વાઈ ગયા બાદ કમલાબેન માંગીલાલ કુમાવત દ્વારાઆ જમીન પરત્વે અમારા અસીલને રજીસ્ટર બાનાખત મુજબ નું પાલન ન થતા અમારા અસીલે અમદાવાદના નામદાર સીટી સીવીલ કોર્ટ માં Spe- cial Civil Suit No. 43/2025 થી Specific Relief Act - 1934 ની section 16 ત. 10.01.2025 ના રોજસ્પેસિક પર્ફોમન્સનો દાવો દાખલ કરેલ છે. જેમાં કમલાબેન માંગીલાલ કુમાવત હાજર થઇ ગયેલ છે. જે દાવો હાલ નામદાર કોર્ટ સમક્ષ પેન્ડીંગ છે તેમજ કમલાબેન માંગીલાલ કુમાવત વિસ્દ્ધ અમારા અસીલે ઈ. પી. કો. ક. ૩૪, ૧૨૦બી, ૪૦૬, ૪૦૯, ૪૨૦, ૪૬૭ ૪૬૮, ૧૯૧, ર૨૦૨, ૫૦૬(૧), ૫૦૬(૨) અને ૧૧૪મુજબ ઓઢવ પોલીસ સ્ટેશનમાં ફોજદારી ફરિયાદ કરેલ છે. આથી હાલની કાનૂની જાહેર ચેતવણી થી જાહેર જનતાને ચેતવવામાં આવે છે કે આ જમીન પરત્વે અમારા અસીલતો વેચાણ લેવાનો અગ્રતા ક્રમ રહેલહોઈઆ જમીન પરત્વે કોઈ પણ વ્યક્તિ/ઓ કે સંસ્થા એ કોઈ પ્રકારનો ખરીદ - વેચાણ - ગીરો - બક્ષીસ કે અત્ય કોઈ પણ પ્રકારનો વ્યવહાર/વ્યવહારો કરવા-કરાવવા નહિ. તેમ છતાં આવા કોઈ પણ વ્યવહાર/વ્યવહારો કરવા-કરાવવામાં આવશે તો તે ગેરકાયદેસર/નલ એન્ડ વોઈડ ગણાશે તેમજ ફોજદારી કૃત્ય ગણાશે અને આવા વવવહાર/વ્યવહારો બાબતે જે તે વ્યક્તિની અંગત જવાબદારી રહેશે અને આવા કોઈ પણ વ્યવહાર અમારા અસીલને બંધનકર્તા રહેશે નહિ. જેની જાણ હાલની આ ચેતવણીથી જાહેર જનતાને ચેતવવામાં આવે છે. મુ.અમદાવાદ તા.૨૦.૦૩.૨૦૨૫ જગદેવ શર્મા અમારી મારફત નરેન્દ્ર આર.માધુ, એડવોકેટ ઠે. નરેન્દ્ર માધુ એસોસિએટ્સ, ૮૦૬-૯૦૭, સત્યમ ૬૪, ગુજરાત હાઇકોર્ટ ની સામે, સોલા-૩૮૦૦૬૦, અમદાવાદ. મો. ૯૮૨૫૭૪૪૬૮૧, ૯૪૦૮૮૮૪૪૫૫
