Indian State Bank Structured Assets Recovery Branch, 2nd Floor, Samyak Status, D R Amin School Opposite, Diwali Pura Main Road, Vadodara-390004 (Rule 8(1) Possession Notice (for Immovable Property)) This is to inform that the undersigned authorized officer of Indian State Bank, Structured Assets Recovery Branch, 2nd Floor, Samyak Status, D R Amin School Opposite, Diwali Pura Main Road, Vadodara-390004, using the power vested in him under Section 13(4) read with Rule 8 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest (Act), 2002 and the Security Interest (Enforcement) Rules 2002, issued a Demand Notice dated 03.01.2024. Against which the debtors M/s Opti Engineering Private Limited, Smt. Kishnabhen Bharat Thakar (Debtor and Guarantor), Smt. Jigna Manish Naik (Debtor and Guarantor) and Shri Manish Manubhai Naik (Guarantor) failed to pay the sum of Rs. 50,84,942.11 (Rupees Fifty Lakhs Eighty Four Thousand Nine Hundred Forty Two and Paisa Eleven Only) as per 03.01.2024 including subsequent recovery along with the interest at the contractual rate and other incidental charges as per the notice within 60 days from the date of receipt of this notice. The debtors have failed to return the amount, therefore, the debtors, legal heirs (known-unknown), legal representatives (known-unknown), guarantors and the public are hereby informed that the undersigned has taken symbolic possession of the following property on 10th August 2024, using the power vested in him under Section 13(4) read with Rule 8 of this Act. The debtors and the public are hereby warned against dealing with the property and any dealings with the property shall be subject to the payment of the entire amount of Rs. 50,84,942.11 (Rupees Fifty Lakhs Eighty Four Thousand Nine Hundred Forty Two and Paisa Eleven Only) as per 03.01.2024 including subsequent recovery along with interest at the contractual rate and other incidental expenses, principal, charges etc. till the date of the payment. Debtors are requested to take note of the provisions of sub-clause (8) of Section 13 of the SARFAESI Act regarding the time available for redemption of the secured property. Description of immovable property The immovable property is Flat No. 401 (Penthouse) Tower-A 4th and 5th Floor, Shubham Residency, Opposite Abhishek Society, Behind Swaminarayan Temple, ISKON-Vasna Road, Vadodara, having C.S. No. 1146/1, R.S. No. 250, T.P. 6, F.P. No. 72, measuring 3200 Sq. ft. (Super Built Up Area) with undivided share in the land of 96.10 sq. meters. (નિયમ ૮(૧) કબજા નોટિસ (સ્થાવર મિલકત માટે) આથી નીચે સહી કરનાર અધિકૃત અધિકારી ભારતીય સ્ટેટ બેંક, સ્રેરડ એસેટ્સ રીકવરી શાખા, બીજો માળ સમ્યક સ્ટેટસ, ડી આર અમીન સ્કુલ સમે, દિવાળીુરા મેઇન રોડ, વડોદરા- ૩૯૦૦૦ સીક્યુરીટાઇઝેશન એન્ડ રીક્ન્જટ્કશન ઓફ ફાયનાન્સ એસેટ્સ એન્ડ એન્ફ્ોસમિન્ટ ઓફ સીક્યુરિટી ઇન્ટરેસ્ટ (એક્ટ), ૨૦૦૨ અને સીક્યુરીટી ઇન્ટરેસ્ટ (એન્ફોસમિન્ટ) નિયમો ૨૦૦૨ની કલમ વ૩ (૧૨) હેઠળ નિયમ ૩ સાથે વંચાણે લઇને મળેલી સતાનો ઉપયોગ કરીને તારીખ ૦૩.૦૧.૨૦૨૪ના ડીમાન્ડ નોટિસ જારી કરવામાં આવી હતી. જેના દેવાદાર મેસર્સ ઓપ્ટી એન્જીનીયરીંગ પ્રાઈવેટ લિમિટેડ, શ્રીમતી કિષ્નાબેન ભરત ઠાકર (ન્ટિશાક અને જામીનદાર), શ્રીમતી જીજ્ઞા મનીષ નાઈક (ન્ટરાક અને જામીનદાર) અને શ્રી મનિષ મનુભાઈ નાઈક (જમીનદાર) દ્વરા નોટિસમા દશવિલી રકમ રૂપિયા ૫૦,૮૪,૯૪૨.૧૧ (રૂપિયા પચાસ લાખ ચોર્યાસી હજાર નવસો બેતાલીસ અને પૈસા અગિયાર પુરા) ૦૩.૦૧.૨૦૨૪ મુજબના બાદ- ત્યાર બાદ આવેલી વસુલાત સહિત ઉપરોક્ત રકમના કરારી દરે આગામી વ્યાજ સહ્તિઆકરસ્મિક ખય, મુદ્લ ચાર્જ આ નોટિસ મળ્યાની તારીખથી ૬૦ દિવસોમા ચુકવવા જણાવાયું હતું. દેવાદારો રકમ પરત ચુકવવામાં નિષ્ફળ ગયા છે, આથી દેવાદારો, કાયદેસરના વારસો (જાણીતા-અજાણ્યા), કાયદેસરના પ્રતિનિધિ (જાણીતા-અજાણ્યા), જામીનદાર અને જાહેરજનતાને નોટિસ આપી જણાવવાનું કે નીચે સહી કરનારે આ કાયદાની કલમ ૧૩(૪) હેઠળ નિયમ ૮ સાથે વંચાણે લઇને મળેલી સતાનો ઉપયોગ કરીને નીચે વણવિલી મિલકતનો સાંકેતિક કબજો ૧૦ ઓગસ્ટ ૨૦૨૪ ના રોજ લઈ લીધો છે. ખાસ કરીને દેવાદારો અને જાહેર જનતાને આથી મિલકત સાથે વ્યવહાર કરવા સામે ચેતવણી આપવામાં આવે છે અને મિલકત સાથેનો વ્યવહાર ભારતીય સ્ટેટ બેંકની કુલ રકમ કૃપિયા ૫૦, ૮૪,૯૪૨.૧૧ (રૂપિયા પચાસ લાખ ચોચાસી હજાર નવસો બેતાલીસ અને પૈસા અગિયાર પુરા) ૦૩,૦૧,૨૦૨૪ મુજબના બાદ- ત્યાર બાદ આવેલી વસુલાત સહિત ઉપરોક્ત રકમના કરારી દરે આગામી વ્યાજ સહિત મુદેલ વગેરે પૂરી રકમ ચુક્વો તે તારીખ સુધીની અને આકસ્મિક ખચાઓ , મુદલ, ચાજુસને આધીન રહેશે. સલામત મિલકતો છોડાવવા માટે, ઉપલબ્ધ સમય અંગે દેવાદારોને સરફેશી કાયદાની કલમ વ૩ની પેટા ક્લમ (૮)ની જેગવાઇ પર ધ્યાન દોરવામાં આવે છે. સ્થાવર મિલકતોનું વર્ણન સ્થાવર ગિલકત ફ્લેટ નંબર ૪૦૧ (પેન્ટ હાઉસ) ટાવર-એ ચોથો અને પાંચમો માળ, શુભમ રેસીડેન્સી અભિષેક સોસાયટી પાસે, સ્વામિનારાયણ મંદિરની પાછળ, ઇસ્કોન-વાસણા રોડ, વડોદરા, આર.એસ. નંબર ૨૫૦ પેકી, ટી. પી. ૬, એફ.પી. નંબર ૭૨, ધરાવતી સી.એસ. નંબર ૧૧૪૬/૧, ૯૬.૧૦ ચોરસ ગીટરની જમીનમાં અવિભાજિત હિસ્સા સાથે ૩૨૦૦ ચોરસ ફૂટ (સુપર બિલ્ટ અપ એરિચા)નું માપન, તેની ચતુર્સીમા નીચે મુજબ છે.ઃ પૂ બિલ્ડિંગ માર્જિન છોડ્યા પછી અભિપેક સોસાયટી, પશ્ચિમ: ફ્લેટ નંબર (લિંગ માજિન છોડ્યા પછી અયોધ્યાપુરી સોસાયટી , દક્ષિણ: આંતરિક રોડ (છ.૦૮.૨૦૨૪ અધિકૃત અધિકારી ભારતીય સ્ટેટ બેંક - એસએઆરબી વડોદરા
